Terms of Service

The terms governing your use of WAYSCloud services, websites, and platforms.

1. Introduction

These Terms of Service (“Terms”) govern the use of services provided by WAYSCloud AS (“WAYSCloud”, “we”, “us”).

WAYSCloud is the brand name of WAYSCloud AS, a company established in Norway.

By accessing or using WAYSCloud services, websites, or platforms, you agree to be bound by these Terms.

If you are entering into these Terms on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not use WAYSCloud services.

2. Services and accounts

WAYSCloud provides cloud infrastructure, platform services, and related functionality (“Services”).

To use the Services, users must create an account and provide accurate and complete information.

Users are responsible for:

  • Maintaining the confidentiality of their account credentials
  • All activities performed under their account
  • Ensuring that their use of the Services complies with applicable laws and these Terms

WAYSCloud may suspend or restrict access to the Services in cases of:

  • Suspected or actual misuse of the Services
  • Security risks or threats to the platform
  • Violation of these Terms
  • Failure to pay for Services when due

Users are responsible for ensuring that their use of the Services is properly configured and secured.

3. Acceptable use

Users may only use WAYSCloud Services for lawful purposes and in accordance with these Terms.

The following activities are strictly prohibited:

  • Any use of the Services for illegal activities or in violation of applicable laws or regulations
  • Unauthorized access to systems, networks, or data
  • Distribution of malware or malicious code
  • Conducting denial-of-service (DoS) or other disruptive attacks
  • Abuse of system resources affecting service stability
  • Sending spam, phishing, or fraudulent communications
  • Hosting or distributing unlawful or harmful content
  • Interfering with WAYSCloud infrastructure or services

WAYSCloud Services must not be used for activities that may cause harm to individuals, organizations, or society at large.

This includes, but is not limited to:

  • Systems intended to cause physical harm or large-scale disruption
  • Use in connection with weapons development or unlawful military activities
  • Violations of fundamental rights or privacy

WAYSCloud reserves the right to determine, at its sole discretion, whether a use case violates this section.

WAYSCloud may take immediate action, including suspension or termination, without prior notice.

4. Billing and payments

WAYSCloud Services are billed based on applicable pricing and actual usage.

Payment methods

For private individuals and standard accounts, payment is required by credit or debit card.

Business customers in the Nordic region may apply for invoicing or credit-based payment terms, subject to approval.

Billing cycle

Services are billed on a postpaid basis.

Charges are normally invoiced or charged on the first day (1st) of the following month.

WAYSCloud may charge earlier if usage thresholds are reached.

Automatic payments

WAYSCloud will attempt to charge the registered payment method.

If a payment fails, WAYSCloud may retry up to three (3) times.

Late payment and suspension

WAYSCloud may suspend access if payment is not completed.

Access may remain suspended until outstanding amounts are settled.

WAYSCloud is not responsible for losses resulting from suspension.

Repeated payment failure

Repeated non-payment may result in account termination.

Debt collection

WAYSCloud may refer unpaid balances to third-party debt collection services.

Customers are responsible for any associated recovery costs.

Taxes

Customers are responsible for applicable taxes.

Refunds

Payments are non-refundable unless required by law.

5. Termination

Termination by the user

Users may terminate services at any time.

Termination may take effect immediately or at the end of the billing period depending on the service.

Account termination

Users must:

  • Export their data
  • Contact support
  • Settle outstanding balances

Final billing

A final invoice will be issued upon termination.

Post-termination access

Read-only access may be available for up to 30 days.

Reactivation

Accounts may be reactivated within 30 days.

Data retention

Data is handled according to our Privacy Policy.

6. Limitation of liability

WAYSCloud provides services on an “as-is” basis.

WAYSCloud shall not be liable for:

  • Indirect or consequential damages
  • Loss of profits or data
  • Service interruptions

Liability is limited to the amount paid by the customer in the previous 12 months.

Users are responsible for backups and proper configuration.

7. Governing law

These Terms are governed by Norwegian law.

Disputes shall be handled by Norwegian courts.

8. Changes to the Terms

WAYSCloud may update these Terms.

Continued use constitutes acceptance of changes.

9. Miscellaneous

If any provision is invalid, the rest remain valid.

These Terms constitute the entire agreement.
